Kanye West will not face charges for allegedly punching a fan who asked for an autograph outside a Los Angeles hotel in January.

As the 45-year-old artist was being investigated for criminal battery, the Los Angeles City Attorney’s Office issued a statement Tuesday to TMZ that revealed there was insufficient evidence.

It read: ‘After a thorough and careful review of all evidence, our office is refusing to file on the grounds that there is no reasonable likelihood of conviction.’

The case was being investigated as a misdemeanor battery, which carries a maximum sentence of six months in prison.

Back in January, Kanye reportedly got into an argument with a fan outside the Soho Warehouse, a members-only club, in downtown Los Angeles, Fox 11 reports.

In a video obtained by TMZ, an angry West can be heard shouting ‘Get away from me!’ On a woman who seems to be trying to pacify him.’

In the video, the woman is saying to West, ‘I am your family.’ She is considered his aunt.

As she tries to calm him down, she says, ‘Give me your hand,’ to which an angry West retorts: ‘No, get away from me! There is no hand, no hand.’

Then the woman further says, ‘I am your family. Give me your hand.’

West was then heard telling him, ‘You should have talked to him!’

However, it is not clear who the rapper is referring to.

The footage shows the autograph hunter sitting on the sidewalk. TMZ reports that West allegedly punched her twice, first in her neck and then on her head.

According to reports, the fan approached West, who was sitting in his SUV outside the club, and asked for his autograph, which reportedly led to a heated argument.

Then the argument turned physical and West allegedly punched the fan, causing him to fall to the ground.

As FOX 11 reports, West was not at the scene when officers arrived.

A video obtained by TMZ that was reportedly taken by a bystander around the same time as the incident shows a clearly enraged West.

He is heard shouting, ‘Did you say that or not? Did everyone say no? Because that’s what just happened, f-king.’

A police spokesman confirmed that no arrests had been made and that the LAPD was investigating the matter.

Earlier in the evening, Madonna and Floyd went on a star-studded dinner date with girlfriend Julia Fox in Delilah, West Hollywood, after spending the evening with Mayweather.

The group appeared to be in high spirits after Diana Ross’ son Evan Ross shared video footage of them on Instagram.

While it was previously reported that West’s new romance may have gotten under the skin of his estranged wife, Kim Kardashian, sources claimed that he is happy to see the Donda artist smile again.

West, who is no stranger to controversy, has had her share of rage over the years.

Kim initially filed for divorce in early 2021, but months were seen by her side in support of her new album release.

In an amusing interview with Revolt TV last November, which included several digressions and left turns, he discussed the jokes Kim made about their split while hosting Saturday Night Live last month.

In her opening monologue, Kim, 41, quipped: ‘When I divorced her, you should know it came down to just one thing: her personality.’

Addressing the dig, West retorted: ‘SNL told my wife “I divorced her” on TV because they just wanted to remove that bar… and I never even looked at the papers, we even divorced. Not Taken.’

‘I want us to be together,’ West insisted it was not ‘the media’ that he and Kim settled their differences.

Kanye split from Julia in February, a month after the alleged incident.
