An Italian mother fed up with her grown sons’ freeloading ways has won an unusual court case to have the pair of “parasites” evicted from her home.
The plaintiff, identified only as a 75-year-old retiree living in the northern city of Pavia, had filed a lawsuit in the Tribunal of Pavia, accusing her sons, ages 40 and 42, of overstaying their welcome, CNN reported, citing information from a local court clerk.
According to the complaint, both grown men, whom the disgruntled parent labeled “parasites” in the court filing, are employed but have continued living in her apartment rent-free.
The mother is separated from her husband and lives off her pension, all of which goes toward home upkeep and food.
The duo of moochers have not been contributing financially, or even helping around the house with chores, the lawsuit claimed.
Judge Simona Caterbi sided with the mother, ruling this week that the sons, whom she mocked as “bamboccioni,” or “big babies,” have until Dec. 18 to move out of their mother’s apartment.
“There is no provision in the legislation which attributes to the adult child the unconditional right to remain in the home exclusively owned by the parents, against their will and by virtue of the family bond alone,” she wrote in her decision obtained by the local news site Prima Pavia.
In Italy, it is common and culturally acceptable for grown children in their 30s to still be living with their parents.
The practice of lingering in the family home well into adulthood is especially common among men, who are dubbed “mammoni,” or “mama’s boys.”
Armed with this knowledge, the woman’s sons have lawyered up and countersued their mother to stop her from evicting them, arguing that Italian parents are obligated by law to “maintain” — or support — their children as long as needed.
In her decision issued Tuesday, Judge Caterbi acknowledged the existing law, but she argued that “it no longer appears justifiable considering the two defendants are subjects over 40, and once a certain age has been exceeded, the child can no longer expect the parents to continue the maintenance obligation beyond limits that are no longer reasonable.”
The attorney representing the sons told local news outlets the two had not decided yet if they would appeal the eviction order.
